Diese Nutzungsbedingungen gelten für die Nutzung der iOS-Anwendung „Euclidar" (im Folgenden „App"), angeboten von Matthias Temmen, Kopernikusstr. 11, 49088 Osnabrück, Deutschland (siehe Impressum). Die App wird ausschließlich über den Apple App Store vertrieben.
Der Bezug, die Zahlungsabwicklung und der Lizenzerwerb der App erfolgen über den Apple App Store und unterliegen zusätzlich den jeweils aktuellen Nutzungsbedingungen von Apple, insbesondere dem Standard-Lizenzvertrag für Endnutzer (Licensed Application End User License Agreement, „Apple-EULA"). Im Falle eines Widerspruchs zwischen diesen Nutzungsbedingungen und dem Apple-EULA hat das Apple-EULA hinsichtlich Fragen des Kaufvorgangs, der Zahlungsabwicklung und der Lizenzgewährung Vorrang. Diese Nutzungsbedingungen ergänzen das Apple-EULA um Regelungen zur inhaltlichen Nutzung und Haftung, die spezifisch für „Euclidar" gelten.
Euclidar ermöglicht die Messung von Entfernungen, Winkeln und Flächen mithilfe des LiDAR-Scanners kompatibler Apple-Geräte. Die App wird nach dem Freemium-Modell angeboten: Ein Basisumfang steht kostenlos zur Verfügung, einzelne Zusatzfunktionen können über In-App-Käufe freigeschaltet werden. Der jeweils aktuelle Umfang der kostenlosen und kostenpflichtigen Funktionen wird in der App-Store-Beschreibung sowie innerhalb der App angezeigt und kann sich im Rahmen von App-Updates ändern.
Die von Euclidar ermittelten Messwerte basieren auf dem LiDAR-Sensor und der Sensorik des jeweiligen Endgeräts sowie auf Software-Kalibrierung und -Korrektur. Trotz Burst-Fusion, Ausreißerentfernung und Geräte-Kalibrierung können Messwerte durch Umgebungsbedingungen (Lichtverhältnisse, Materialoberflächen, Reflexionen, Bewegung), Gerätezustand (z. B. verschmutzter Sensor, nicht hinterlegte Schutzhülle) oder Sensortoleranzen abweichen. Die App ist ein Hilfsmittel zur Orientierung und Dokumentation und ersetzt keine geeichten oder zertifizierten Messgeräte. Für sicherheitsrelevante, bauaufsichtlich relevante, medizinische oder anderweitig verbindliche Messungen (z. B. amtliche Vermessung, statische Berechnungen, Bauabnahmen, Gesundheitsanwendungen) ist die App nicht geeignet; hierfür sind kalibrierte Fachgeräte und/oder qualifizierte Fachpersonen heranzuziehen.
Im Rahmen des Erwerbs über den Apple App Store wird dir ein einfaches, nicht ausschließliches, nicht übertragbares Recht zur Nutzung der App im Umfang der jeweils erworbenen Lizenz (kostenloser Basisumfang bzw. zusätzlich erworbene In-App-Funktionen) im Rahmen der Apple-Nutzungsbedingungen eingeräumt. Eine Weitergabe der Lizenz an Dritte, ein Reverse Engineering (soweit gesetzlich nicht zwingend zulässig) sowie eine Nutzung außerhalb des bestimmungsgemäßen Gebrauchs sind nicht gestattet.
Du bist dafür verantwortlich, die App nur im Einklang mit geltendem Recht zu nutzen, insbesondere Persönlichkeits-, Datenschutz- und Hausrechte Dritter zu beachten, wenn du mit der Kamera- und LiDAR-Funktion Aufnahmen von Personen, fremdem Eigentum oder nicht öffentlich zugänglichen Orten anfertigst.
Es gelten die gesetzlichen Gewährleistungsrechte. Da die App ausschließlich über den Apple App Store vertrieben wird, richten sich etwaige Gewährleistungsansprüche im Zusammenhang mit dem Kaufvorgang zunächst nach den Apple-Nutzungsbedingungen; unbeschadet dessen bleiben die gesetzlichen Gewährleistungsrechte gegenüber dem Anbieter der App im Rahmen der geltenden gesetzlichen Vorschriften unberührt, soweit diese nicht durch die Apple-Bedingungen wirksam abbedungen werden können.
Ich hafte unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie nach den Vorschriften des Produkthaftungsgesetzes und für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Für Schäden aus der Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) durch einfache Fahrlässigkeit hafte ich beschränkt auf den vertragstypisch vorhersehbaren Schaden. Im Übrigen ist die Haftung für einfache Fahrlässigkeit ausgeschlossen. Diese Haftungsbeschränkungen gelten nicht für Schäden, die aus fehlerhaften Messwerten resultieren, sofern diese auf einer bewusst herbeigeführten Fehlfunktion beruhen; im Übrigen gilt der Genauigkeitshinweis unter Ziffer 4.
Funktionsumfang und Verfügbarkeit einzelner Funktionen können sich durch App-Updates ändern. Diese Nutzungsbedingungen können bei Bedarf angepasst werden, etwa bei geänderten rechtlichen Vorgaben oder Funktionsänderungen der App. Es gilt die jeweils aktuelle, auf dieser Seite veröffentlichte Fassung.
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Bist du Verbraucher und hast deinen gewöhnlichen Aufenthalt in einem anderen Staat der Europäischen Union, bleiben zwingende verbraucherschützende Bestimmungen dieses Staates von dieser Rechtswahl unberührt. Für Nutzer außerhalb der EU wird empfohlen, zusätzlich lokale Verbraucherschutzvorschriften zu berücksichtigen, da diese Nutzungsbedingungen primär auf das deutsche und europäische Recht zugeschnitten sind.

These terms of use govern the use of the iOS application "Euclidar" (the "App"), offered by Matthias Temmen, Kopernikusstr. 11, 49088 Osnabrück, Germany (see Legal Notice). The App is distributed exclusively through the Apple App Store.
The purchase, payment processing, and licensing of the App take place through the Apple App Store and are additionally subject to Apple's then-current terms, in particular the Licensed Application End User License Agreement ("Apple EULA"). In the event of a conflict between these terms of use and the Apple EULA regarding the purchase process, payment handling, or license grant, the Apple EULA takes precedence. These terms of use supplement the Apple EULA with provisions on content use and liability specific to "Euclidar."
Euclidar enables the measurement of distances, angles, and surfaces using the LiDAR scanner of compatible Apple devices. The App is offered on a freemium basis: a base feature set is available free of charge, and individual additional features may be unlocked via in-app purchase. The current scope of free and paid features is shown in the App Store listing and within the App itself, and may change as part of App updates.
Measurement values produced by Euclidar are based on the LiDAR sensor and other sensors of your device, combined with software calibration and correction. Despite burst fusion, outlier rejection, and device calibration, measured values may deviate due to environmental conditions (lighting, surface materials, reflections, motion), device condition (e.g. a dirty sensor, an unregistered protective case), or sensor tolerances. The App is an aid for orientation and documentation purposes and does not replace calibrated or certified measuring instruments. The App is not suitable for safety-critical, building-code-relevant, medical, or otherwise legally binding measurements (e.g. official surveying, structural calculations, building inspections, health applications); calibrated professional equipment and/or qualified professionals should be used for those purposes.
Through your purchase via the Apple App Store, you are granted a simple, non-exclusive, non-transferable right to use the App to the extent of the license acquired (free base feature set and/or additionally purchased in-app features), subject to Apple's terms of use. Sublicensing to third parties, reverse engineering (except where mandatorily permitted by law), and use outside the App's intended purpose are not permitted.
You are responsible for using the App only in compliance with applicable law, in particular for respecting third parties' personality, privacy, and property rights when using the camera and LiDAR functions to capture people, others' property, or non-public locations.
Statutory warranty rights apply. Because the App is distributed exclusively through the Apple App Store, any warranty claims related to the purchase transaction itself are primarily governed by Apple's terms of use. This is without prejudice to your statutory warranty rights against the App's provider under applicable mandatory law, to the extent such rights cannot be effectively excluded by Apple's terms.
I am liable without limitation for intent and gross negligence, under the German Product Liability Act, and for damages arising from injury to life, body, or health. For damages resulting from a breach of material contractual obligations (cardinal obligations) caused by ordinary negligence, my liability is limited to the foreseeable damage typical for this type of contract. Liability for ordinary negligence is otherwise excluded. These limitations do not apply to damages resulting from inaccurate measurements caused by a deliberately induced malfunction; otherwise, the accuracy notice in Section 4 applies.
The scope and availability of individual features may change through App updates. These terms of use may be updated as needed, for example due to changes in legal requirements or the App's functionality. The version published on this page at any given time applies.
These terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another EU member state, mandatory consumer-protection provisions of that state remain unaffected by this choice of law. If you are located outside the EU, you should additionally consider your local consumer-protection rules, as these terms are primarily drafted with German and EU law in mind.
